Brad Tupi is the lawyer in charge of Tucker Arensberg's environmental law practice. He is currently engaged in opposing a permit for the Shaffer Mountain wind energy project in Somerset County and in suing companies responsible for the Allegheny Ridge wind energy facility in Cambria and Blair Counties.

Brad and his clients have brought the adverse environmental impacts of the Shaffer Mountain project to the attention of DEP, the U.S. Fish & Wildlife Service, the PA Game Commission, the PA Fish & Boat Commission, and various state and local officials. So far, these efforts have caused DEP to deny the developer the NPDES permit necessary to begin construction. Should a permit be issued, Brad and his clients are prepared to file an appeal with the PA Environmental Hearing Board.

The Allegheny Ridge wind facility began operation in 2007, and generates much more noise than the developer represented to local residents and officials. Brad represents two homeowners who live in proximity to five of the giant industrial turbines. On their behalf, Brad has filed suit in Blair County Common Pleas Court, seeking monetary damages for noise and vibrations that disturb his clients' peaceful enjoyment of their property.

Brad has been practicing law since 1978 in New York and Pennsylvania. His diverse environmental experience includes cases involving hazardous waste sites, underground and above ground storage tanks, chemical exposures, and environmental due diligence in real estate transactions.
